【摘

要】

美国是目前刑事法律援助运作最有效率的国家之一，其健全的刑事法律

援助制度为美国刑事案件的法律援助工作开展提供了强有力的保障，特别是公设辩

护人制度，作为美国刑事法律援助的重要手段，为实现经济困难的被告人的辩护权

提供了切实保障。在评介美国刑事法律援助体系之公设辩护人制度的基础上，结合

我国现有的刑事法律援助体系，构建我国公设辩护人制度，将其作为我国刑事法律

援助手段之一，实行多元化的刑事法律援助制度，使我国的刑事法律援助事业变得

真实有效，进一步完善我国司法保障体系。

%The United States is one of 

countries with the most efficient national criminal legal aid work, in which 

the perfect criminal legal aid system supply a strong guarantee for the 

legal aid work operation. The public defender system, as an important 

means, especially supply effective guarantee for the right of the defendant 

with financial difficulty. Basing on the USA public defender system of 

criminal legal aid system, combining with our existing criminal legal aid 

system, we should build up China public defender system, as one of the 

criminal legal aid means in our country, diversify the criminal legal aid 

system so as to make the criminal legal aid work real and effective, and 

further improve China judicial system.
