CONDITIONS DE VENTE

1. La vente aux enchères a lieu au nom et pour le compte de tiers et mandants et en monnaie suisse. Le paiement devient exigible dès

l’adjudication.

2. Le texte de ce catalogue a été rédigé avec la meilleure conscience et connaissance et en utilisant les descriptions des différents objets transmises

à Dobiaschofsky Auktionen AG. Ces indications sont sans engagement. Des signatures, attributions, époques, parties réparées, état

général etc. sont à vérifier par l’intéressé ou par un expert de son choix avant la vente aux enchères, pendant l’exposition et des expertises

éventuelles indiquées dans le texte doivent être consultées.

Toute garantie en cas de vices matériels ou juridiques est exclue. Des réclamations ne peuvent plus être prises en considération après

l’adjudication.

Comme la vente aux enchères a lieu pour le compte de tiers et que Dobiaschofsky Auktionen AG est tenue par les conditions de consignation,

toute reprise d’objet est exclue. La visite de l’exposition est donc vivement recommandée. Une prudence particulière doit être observée durant

l’exposition, car chaque visiteur est responsable des dégâts causés. Les objets sont adjugés dans l’état dans lequel ils se trouvent au moment

de la vente aux enchères.

3. Des ordres et des offres sont acceptés via notre site web, par écrit et durant la période d’exposition par notre personnel à la galerie. Ces offres

sont fermes et ne peuvent plus être retirées. Les ordres passés par téléphone doivent être confirmés par écrit. Tout ordre écrit ou oral équivaut

à une offre d’achat ferme, aussi longtemps qu’il n’y a pas de surenchère. Les offres écrites sont en concurrence avec des offres dans la salle

et des offres téléphoniques. Les offres stipulées dans les ordres d’achat s’entendent sans commission d’achat ni TVA. Nous vous prions de

remplir soigneusement les ordres d’achat. En cas de divergence entre le numéro dans le catalogue et les détails de l’objet, c’est le numéro du

catalogue qui fait foi. Des offres en dessous de la limite ne peuvent pas être prises en considération.

Les enchérisseurs présents en personne doivent s’identifier à l’accueil en indiquant leur adresse avant d’entrer dans la salle de vente aux

enchères. Contre signature ils reçoivent un numéro d’enchérisseur pour participer à la vente dans la salle.

4. La vente a lieu dans l’ordre indiqué dans le catalogue et dans le programme de la vente aux enchères (+/- 45 min.). Dobiaschofsky Auktionen

AG a néanmoins le droit de réunir, de dissocier et d’éliminer des numéros du catalogue ou d’offrir les objets dans un ordre différent. Lors des

offres simultanées, des malentendus ou d'une erreur lors de l’adjudication, celles-ci sont immédiatement répétées par le commissaire-priseur.

En cas d’offres écrites équivalentes, c’est l’ordre d’arrivée qui départage les intéressés.

5. S’ajoute au prix d’adjudication de chaque objet une commission d’achat dont le montant est fixé comme suit:

Prix d’adjudication jusqu’à y compris CHF 200'000.-: 22%, prix d’adjudication à partir de CHF 200'000.-: 20%.

Cette commission est soumise à la TVA suisse (7.7%).

Si l'acheteur enchérit en directe sur Internet lors d'une vente aux enchères en salle transmise en directe ou fait une offre préalable via un autre

site lié à Dobiaschofsky Auktionen AG, une commission supplémentaire de 3 - 5% selon le fournisseur (plus TVA suisse) du prix d’adjudication

sera facturée. Pour ces enchères, les conditions publiées sur le site Internet des enchères en directe s'appliquent. Celles-ci peuvent être différentes

des conditions publiées ici.

Pour les lots marqués d’un *, le prix d’adjudication comme la commission sont assujettis à la TVA. Contre présentation d’un certificat

d’exportation dûment tamponné par la douane suisse, la maison Dobiaschofsky rembourse la TVA suisse sur ces objets.

Le transfert de propriété à l’acheteur s’effectue qu’après paiement intégral, le transfert des risques dès l’adjudication. La remise des objets de

la vente n’a lieu qu’après le règlement en espèces ou après réception de l’avis de crédit.

En cas de retard de paiement, l’acheteur est tenu responsable de tous les dommages y résultant. De plus, toutes les créances sont soumises

à un taux d’intérêt mensuel de 1%. Dans ce cas, Dobiaschofsky Auktionen AG peut demander l’exécution du contrat d’achat ou réclamer des

dommages-intérêts pour inexécution, déclarer l’acheteur déchu de ses droits et remettre l’objet aux enchères aux frais de l’acheteur. Dans ce

cas l’acheteur assume la responsabilité en cas de défaillance, par contre il ne peut pas se prévaloir d’un droit sur des gains supplémentaires.

Il n’est pas autorisé à faire une offre d’achat.

6. Les achats doivent être retirés dès mardi après la vente, dans les dix jours. (Lundi après la vente la galerie reste fermée.) Pendant la vente la

remise d’objets est exclue à l’exception après les ventes d’après–midi, dans un cadre restreint et uniquement pour des acheteurs étrangers

contre paiement au comptant. Les objets ne sont pas emballés.

Tout objet non retiré dans le délai susmentionné sera entreposé aux frais et risques de l’acheteur et soumis à des frais de stockage (de CHF

2.- par jour et pièce). Pour tout objet non retiré dans les délais Dobiaschofsky Auktionen AG n’assume aucune responsabilité.

7. Si l’objet ne peut pas être retiré personnellement et un transport ou une expédition est souhaité, l’acheteur est prié de contacter rapidement

Dobiaschofsky Auktionen AG après la vente, afin qu’un devis puisse être obtenu auprès d’une société de transport. Aucun emballage ni

transport n’est fait par Dobiaschofsky Auktionen AG. Un envoi ou transport éventuel sont aux frais et aux risques de l’acheteur. Dobiaschofsky

Auktionen AG décline toute responsabilité.

8. Le lieu d’exécution et le for judiciaire pour les deux parties est Berne.

Avec chaque offre écrite ou orale, l’enchérisseur reconnaît expressément et sans objections tous les points des conditions de vente

mentionnés ci-dessus.

En cas de litige le texte allemand fait foi.

AUKTIONSBEDINGUNGEN

1. Die Versteigerung erfolgt im Namen und Auftrag Dritter und für Rechnung der Auftraggeber in Schweizer Währung. Die Zahlung wird mit dem

Zuschlag fällig.

2. Der Text dieses Kataloges wurde nach bestem Wissen und Gewissen und unter Verwendung der an die Dobiaschofsky Auktionen AG übermittelten

Objektbeschreibungen erstellt. Für die Angaben wird nicht gehaftet. Signaturen, Zuschreibungen, Epochen, allfällige Reparaturstellen,

Zustand usw. sind vom Kaufinteressenten oder vom Experten seiner Wahl vor der Auktion, während der Vorbesichtigung zu überprüfen und

soweit vorhandene, im Text angegebene Gutachten einzusehen. Jegliche Gewährleistung für Rechts- und Sachmängel wird somit ausdrücklich

wegbedungen. Reklamationen können nach erfolgtem Zuschlag keine Berücksichtigung finden.

Die Dobiaschofsky Auktionen AG versteigert im Auftrag Dritter, welche diese mit den Einlieferungsbedingungen behaften können, weshalb

jegliche Rücknahme von Objekten unter allen Titeln ausgeschlossen ist. Ein eingehender Vorbesichtigungsbesuch ist somit angebracht. Bei

der Vorbesichtigung ist grösste Vorsicht zu empfehlen, da jeder Besucher für den durch ihn angerichteten Schaden haftet. Die Objekte werden

in dem Zustand zugeschlagen, in welchem sie sich im Moment der Versteigerung befinden.

3. Aufträge und Gebote werden über unsere Homepage, auf schriftlichem Weg und während der Vorbesichtigung durch das Ausstellungspersonal

entgegengenommen. Sie sind verbindlich und können nicht mehr zurückgezogen werden. Allfällig telefonisch erteilte Aufträge bedürfen

einer nachfolgenden schriftlichen Bestätigung. Jede Abgabe eines schriftlichen oder mündlichen Gebotes gilt als verbindliche Kaufofferte,

solange dieses Gebot nicht überboten wird. Schriftliche Gebote werden in Konkurrenz mit den Saalbietern und Telefonbietern eingebracht.

In Aufträgen festgelegte Angebote verstehen sich ohne Aufgeld und Mehrwertsteuer. Es wird gebeten, die Auktionsaufträge sorgfältig auszufüllen.

Bei Differenzen zwischen Katalognummer und Objektdetail ist die Katalognummer massgebend. Gebote unterhalb des Limit Preises

können nicht berücksichtigt werden.

Persönlich anwesende Bieter haben sich vor dem Betreten des Auktionssaals beim Empfang zu legitimieren und erhalten gegen Abgabe ihrer

Adresse und Unterschrift eine Bieternummer, mittels welcher sie im Saal Gebote abgeben können.

4. Die Versteigerung erfolgt nach der im Katalog und im Zeitplan (+/- 45 min.) angegebenen Reihenfolge. Die Dobiaschofsky Auktionen AG ist

jedoch berechtigt, Nummern des Kataloges zu vereinen, zu trennen, wegzulassen oder ausser der Reihenfolge anzubieten. Bei gleichzeitigen

Geboten, Missverständnissen oder Irrtum beim Zuschlag, werden diese unverzüglich nochmals aufgerufen. Bei schriftlichen Doppelgeboten

wird das zuerst eingegangene Gebot berücksichtigt.

5. Auf den Zuschlagpreis für jedes Objekt ist folgendes Aufgeld zu entrichten:

Zuschlagpreis bis und mit CHF 200‘000.-: 22%, Zuschlagpreis ab CHF 200‘000.-: 20%.

Auf das Aufgeld ist vom Käufer die schweizerische Mehrwertsteuer (MwSt.) von 7.7% zu bezahlen.

Falls der Käufer während einer online übertragenen Saal-Auktion / Live-Auktion live im Internet mitbietet oder ein Vorgebot über eine fremde

mit der Dobiaschofsky Auktionen AG verlinkten Seite abgibt, wird ein zusätzlicher Aufpreis von 3 - 5% je nach Anbieter (plus schweiz. MwSt.)

des Zuschlags verrechnet. Für diese Gebotsabgaben gelten im Übrigen die Bedingungen, welche auf der Live-Auktion Webseite publiziert

sind. Diese können von den hier publizierten abweichen.

Bei den mit * bezeichneten Losen ist der Zuschlagspreis sowie das Aufgeld mehrwertsteuerpflichtig. Wird von diesen Objekten eine vom

Schweizer Zoll rechtsgültig abgestempelte Ausfuhrdeklaration beigebracht, vergütet die Dobiaschofsky Auktionen AG die schweizerische

MwSt. zurück.

Das Eigentum geht erst nach erfolgter Bezahlung an den Käufer über, der Gefahrenübergang erfolgt bereits mit dem Zuschlag. Die Aushändigung

der Kaufgegenstände erfolgt nach erfolgter Barzahlung oder nach bei uns eingetroffener Gutschrift.

Bei Verzögerung der Zahlung haftet der Käufer für alle daraus entstehenden Schäden. Ausserdem wird für alle Ausstände 1% Zins pro Monat gefordert.

Die Dobiaschofsky Auktionen AG kann in diesem Fall wahlweise Erfüllung des Kaufvertrages oder Schadenersatz wegen Nichterfüllung

verlangen, den Käufer seiner Rechte für verlustig erklären und den Kaufgegenstand auf Kosten des Käufers nochmals zur Versteigerung bringen.

In diesem Fall haftet der Käufer für den Ausfall, dagegen hat er auf Mehrerlös keinen Anspruch. Zu einem Gebot wird er nicht zugelassen.

6. Die ersteigerten Kunstwerke sind ab Dienstag nach der Auktion innert 10 Tagen vollumfänglich zu beziehen. (Am Montag nach der Auktion

bleibt die Galerie geschlossen.) Während der Auktion werden keine Objekte herausgegeben; Ausnahmen werden nach den Nachmittagsauktionen

in beschränktem Rahmen und dies nur an auswärtige Käufer und gegen Barzahlung gemacht. Die Gegenstände sind unverpackt.

Nach den oben genannten Bezugsterminen nicht abgeholte Auktionsware wird auf Kosten und Gefahr des Käufers eingelagert und unterliegt

einer Lagergebühr (von CHF 2.- pro Tag und Stück). Für nicht rechtzeitig abgeholte Gegenstände übernimmt die Dobiaschofsky Auktionen AG

keine Gewähr.

7. Kann das Kunstwerk nicht persönlich abgeholt werden und wird ein Transport bzw. Versand gewünscht, wird der Käufer gebeten, die Dobiaschofsky

Auktionen AG umgehend nach der Auktion zu kontaktieren, damit eine Offerte bei einer Transportfirma eingeholt werden kann. Die

Dobiaschofsky Auktionen AG selbst führt weder Verpackung noch Versand aus. Ein allfälliger Versand oder Transport erfolgt auf Kosten und

Risiko des Käufers. Die Dobiaschofsky Auktionen AG übernimmt keine Haftung.

8. Erfüllungsort und ausschliesslicher Gerichtsstand für beide Teile ist Bern.

Mit jedem abgegebenen schriftlichen oder mündlichen Gebot anerkennt der Bieter ausdrücklich und ohne Einwände sämtliche oben

genannten Punkte der Auktionsbedingungen.

CONDITIONS OF SALE

1. All auction goods are sold in the name and on behalf and for the account of third parties in Swiss currency. The payment becomes due with

the acceptance of bid.

2. This catalogue was prepared to the best of one’s knowledge and belief and based on the descriptions transmitted to Dobiaschofsky Auktionen

AG. However every liability is excluded for the information provided. Signatures, attributions, periods, possible repairs, condition etc. have to be

verified by the prospective buyer or by an expert of his choice before the auction, during the exhibition and expert’s reports, as far as available

and mentioned in the text have to be consulted. Any liability for any legal or material defects is excluded. Complaints after the acceptance of

bid cannot be taken into consideration.

As Dobiaschofsky Auktionen AG sells on behalf of third parties, who can sue the house based on the conditions of consignment, no lot can

be taken back. Buyers should therefore thoroughly examine the object during the exhibition. Extreme caution is recommended during the

exhibition, as every visitor is responsible for any damage caused by him. The objects are sold in the condition they are in at the time of the sale.

3. Orders and bids can be submitted via our homepage, in writing or during the exhibition via our staff. They are binding and irrevocable. Orders

submitted over the telephone have to be confirmed subsequently in writing. Any written or oral bid is considered as a binding purchase offer,

as long as it is not outbid. Written bids stand in concurrence to bids in the room and to telephone bidders. Bid-orders are understood to be

without buyer’s premium and VAT. Bidders are asked to fill in the purchase orders with care. In case of discrepancies between the catalogue

number and the object details, the catalogue number is decisive. Bids below the reserve prices cannot be taken into account.

Bidders that personally take part in the auction have to identify themselves with their name and address at the reception before entering the

auction room and will receive against signature a bidder number allowing them to bid in the auction hall.

4. The sale follows the order indicated in the catalogue and auction schedule (+/- 45 min.). Dobiaschofsky Auktionen AG has however the right

to combine, divide, omit catalogue numbers or to change the order of the sale. In case of simultaneous bids, misunderstandings or error in the

acceptance of a bid, these are immediately called out a second time. In case of double written bids, the date of receipt is determining.

5. The following buyer’s premium is added to the hammer price for every single object:

Hammer price up to and including CHF 200’000.-: 22% hammer price from CHF 200’000.-: 20%.

This commission is subject to Swiss VAT of 7.7% that has to be paid by the purchaser.

If the buyer bids live on the internet during an online transmitted live auction or makes a pre-bid via an external site linked to Dobiaschofsky

Auktionen AG, an additional charge of 3 - 5% depending on the service provider (plus Swiss VAT) of the hammer price will be billed. For these

bids, the conditions published on the live auction website apply. These live auction conditions may differ from the conditions of sale published

in the catalogue.

Regarding the lots marked with *, the hammer price and the commission are subject to Swiss VAT. After presentation of an export declaration

duly stamped by the Swiss customs authorities for the lots marked with *, Dobiaschofsky Auktionen AG will refund the Swiss VAT.

The transfer of ownership only takes place after full payment of the total amount due, but the risk passes already to the buyer with the fall of

the hammer. The purchased items are only delivered after cash payment or after the amount owed has been credited to our bank account.

In case of delayed payment the buyer is liable for any resulting damages. Furthermore, he will be charged with a monthly interest rate of 1%

for the outstanding amount. Dobiaschofsky Auktionen AG may in this case demand the fulfilment of the purchase contract or claim damages

for non-performance of the contract, declare the buyer’s rights forfeited and put the lot again up for auction at the expenses of the buyer. In

this case the buyer is liable for the loss of profit, but has no profit claim. He is not allowed to place a bid.

6. All purchased lots have to be collected within 10 days from the first Tuesday after the sale. (The auction house remains closed on Monday after

the auction.) During the sale, no items can be handed out, except after the afternoon-sales to a limited extent for foreign buyers and against

cash payment only. The items are unpacked.

Uncollected goods after the reference dates aforementioned are stored at the buyer’s risk and expenses and are subject to a storage fee (of

CHF 2.- per day and piece). Dobiaschofsky Auktionen AG assumes no warranty for items not collected in time.

7. If the work of art cannot be picked up personally and a transport or shipment is desired, the buyer is requested to contact Dobiaschofsky

Auktionen AG immediately after the auction, in order to get a quote from a transport company. Dobiaschofsky Auktionen AG does not carry

out package and shipment itself. The buyer bears all costs and risks of any shipping or transport. Dobiaschofsky Auktionen AG assumes no

liability.

8. Place of performance and exclusive jurisdiction for both parties is Berne.

With any submitted written or oral bid, the bidder is accepting all points of the above-mentioned general conditions of sale without

any restriction.In the case of dispute the German original version shall prevail.
