4. on the basis of / in (the) light of / on the strength of

对于普通文本，on the basis of 可以理解为“以……为依据”、“基于……”；in (the) light of “鉴于”、“根据”、“按照”；on the strength of “基于”、“凭借”、“根据”。在法律译本中，用这三者表达“根据”的例子并不鲜见。

（1）如：原告有资格根据合同规定起诉被告。

The Plaintiff shall have the standing to sue the Defendants on the basis of the Contract.

（2）如：特区涉外企业应根据财政部有关会计制度，结合企业的具体情况，制定本企业的会计制度。

Foreign related enterprises in SEZs shall formulate accounting procedures for their enterprises in accordance with relevant accounting procedures of the Ministry of Finance, and in light of specific conditions in the enterprises.

（注：原句的“结合”应该根据上下文理解为“并按照”，因此不能按字面翻译为 in combination of 等表示“组合”的词组或其他单词。）

（3）如：假如发现货品的品质、规格或数量与合约规定不符，买方凭当地商品检验局颁发的检验证书，有权提出更换品质合格的新货品或要求赔偿。

Should the quality, quantity or specifications be found not in conformity with those stipulated in the Contract, the Buyers shall, on the strength of the inspection certificate issued by the Commodity Inspection Bureau of the local government, be entitled to claim for replacement with new qualified goods or for compensation.

注：此例引自《法律翻译译注评》，李老师在书中表示，在一系列表达“根据” 的词汇中，“依据”最可靠、“基础”最坚实的，应该是 on the strength of。什么意思呢？在本例中，买方只要持有“检验证书”，就可以更换货品或索赔，亦即，“检验证书”就是更换货品或索赔最可靠的依据。

5. as per / as + 某些词的过去分词（如：stipulated, provided 等）

（1）陆谷孙的《英汉大词典》中， as per 有“根据”、“按照”的意思。很多在线词典也显示 as per 的这层含义。

如：移民局有权根据法律采取一切补救措施。

The Bureau of Immigration holds the right to employ all remedial actions as perthe law.

其中，as 可省略，因为 per 本身就有“根据”的含义。关于这一点，市井词典（Urban Dictionary，一个查俚语俗语的在线网站）的高票解释还蛮戏谑的，截图给大家看看：

（参考解释：as per 意指“根据”。该词应用普遍，但属冗词赘语。使用者只是为了让表达显得高大上。“per”本身就有“根据”的意思，因此 as 是多余的。）

（2）在法律翻译中，用 as + 动词的过去分词表达“根据”的频率还是挺高的。

如：厂家没有严格根据合同规定的加工要求去做。

The manufacturer didn't strictly observe the proceeding requirements as stipulatedin the contract.

再如：根据银行的规定，所说的这个比率表应该贴在大厅的布告板上。

That rate shall be posted on the bulletin board in the lobby as requiredby bank rules.

6. in pursuance of / pursuant to

在一些法律译本中，也见过使用这两个词表达“根据”的意思。

如：双方应按照合同的约定履行自已的一切义务。

Each party shall fulfill all of its obligations pursuant to the terms hereof.

但李克兴认为：

在现今的法律文本中使用 pursuant to 是相当陈旧的作文风格，使用 in pursuance of 则可谓已经“背时”（即便在律师界也只有极少数人使用）。 现代的英语教育专家都反对在英文写作中继续使用 pursuant to 这个词，认为该词是典型的“法律行话”（legalese），即使在英美法律界也有较高的反对使用的声音。
